These Terms and Conditions ("Terms") govern your access to and use of the Sitemarq platform operated by SITEMARQ LTD ("we", "us", or "our"). By using our platform, you agree to be bound by these Terms.

1. Service Description

Sitemarq is a web-based platform that allows users to:

Create and host websites
Manage tasks using kanban boards
Manage customer relationships (CRM)
Issue and manage invoices
Connect to Stripe via Stripe Connect for payment processing

2. Account Registration

To use Sitemarq, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials.

3. Use of Stripe Connect

If you connect your Sitemarq account to Stripe, you acknowledge that you are subject to the Stripe Connected Account Agreement. We do not store or process your payment information directly.

4. User Responsibilities

You are solely responsible for the content you create, upload, and publish on Sitemarq, including websites, customer data, invoices, and task boards. You must ensure that your use of the platform:

Complies with applicable laws and regulations
Does not infringe on the rights of others
Does not contain or promote illegal, offensive, violent, discriminatory, or indecent content

We reserve the right to remove any content or suspend accounts that violate these rules without prior notice.

5. Prohibited Use

You agree not to use Sitemarq to:

Engage in unlawful, fraudulent, or malicious activities
Host, share, or distribute harmful or misleading content
Infringe the intellectual property or privacy of others
Send spam, phishing, or other unauthorized messages
Attempt to reverse engineer or interfere with the platform’s operations

6. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time if we determine that you have violated these Terms, misused the platform, or engaged in unlawful or indecent behavior. This includes using Sitemarq to create or distribute prohibited content or abusing third-party services like Stripe.

7. Intellectual Property

All intellectual property rights in the Sitemarq platform, including software, branding, and UI elements, remain protected. You may not duplicate, modify, or distribute our platform's code or design without written consent.

8. Data and Privacy

Your use of Sitemarq is also governed by our Privacy Policy. By using the platform, you consent to our data collection and processing practices.

9. Limitation of Liability

We are not liable for any damages arising from your use or inability to use the platform, including loss of data, profits, or business opportunities. Use Sitemarq at your own risk and discretion.

10. Modifications

We may update these Terms from time to time. Material changes will be communicated via the app or email. Continued use of the platform after such changes implies your acceptance.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales. Any legal disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
